In flashden when uploading a file, shows instructions that talk about:

  1. Prepare Your File
  2. Don’t Violate Copyright
  3. Save The File (s)
  4. Create a help file
  5. External Links
  6. ZIP up your files
  7. Save your Preview file
  8. Create a JPEG Thumbnail
  9. Upload your files to FlashDen!

but one of these points which I believe is not being fulfilled or respected. Don’t Violate Copyright

exactly where it says: You may not copy the design/functionality/code of files from FlashDen or elsewhere. There is a fine line between being inspired by another file and copying it. If you upload a file that looks too similar to another file on FlashDen it will be removed and you will receive a warning. Make sure that your file is unique.

I personally say again, this is not complied with, here in flashden I start a search for web templates and I find that most are the same visually, the appearance is limited to differences in some detail but the rest is completely the same.

I think the only difference between them is the name.

I would like, what think the other members of flashden?, and this I don´t is look for fights, this is only my point of view. ;)

You got your point across quite well I think… well, I mean you worded it in a way that is easy to understand. Don’t worry about that.

I agree that there is a redundancy of style. Some people like to create the same thing over and over again. I think its to maintain the sales quota for that individual. I remember I was once a very redundant designer/developer. I got tired of seeing even my own files look the same. But I changed that to an extent. Like you said, its good to be inspired. But there is a difference between copyright infringement and redundancy. However, I think the issue you’re trying to point out is about both of those things.

This is a tough subject and nowadays, it becomes difficult to distinguish between what are the standard elements that can be used by anyone (repeatedly) and what are the elements that should not be allowed to repeat.

Whatever may be the case, I like to point an another perspective: The files having originality in design/functionality produces different range of sales than the ones that comes with standard/usual designs. So I think whatever may be the actions taken in the approval process, the nature of sales will really force everyone to comeup with different (and better) solutions than already existing ones.

And I totally agree with that decision, because we avoid seeing the same thing.

vf, I think that there are already many web templates that have the same functionality and same design, and some are more fortunate than others (the originals), it would be good at least, although they have the same functionality (as is normal in Most of the websites), innovations in the design

Nice subject KenSHinH , but your base principle is kind of wrong .

Many products in this world tend to look the same and this is called functional convergence in technical literature .

I will give you some examples : all the kitchen cookware , electric appliances , cars , garden tools , etc. look alike . At the essence , a spoon is a spoon , right ? You can’t make a spoon look like an axe .

These are limitations of the form given by the function . So , when creating a photo gallery and it looks like a photo gallery , it’s no problem , differences start to show when you implement some fancy transitions , effects , APIs and customization capabilities : for example all cars look alike but they are all distinct by the ” feeling ” , customer service etc.

I hope that elucidates your questions .

But I think what happens is this: for example: The car, the functionality is the same in the majority right? but let’s say that a mark “Y” can´t get the same model already launched another mark “X”, Why? because everyone would call COPY ,

and me at least, I don´t like to have copies of the original.

I think what happened here was the following: I don´t know really who was the first to get the dark style template (same template that time all the time just to put the category templates) but this web template, was a success and that was a point of “inspiration” for others. such as saw that they sold like hotcakes, then from there went to the templates in that style.

flashstar and if you read my second comment. I think that no matter that has the same functionality but if make a different design, innovate, I would like to see a really different and good design.

Let me give an example here:

inspired : you’re waiting for a website to load. While looking at it you notice a bug on the screen and squash it, this makes you think that a flash preloader to a site where smashing bugs as a preloader game would be fun. This is inspiration, where something unrelated inspires a creative idea.

copying : you see a site with bug smashing as a preloader game, you make the same thing, but change the colors, draw different bugs, make a different score system, and do the programming yourself.

Wayyyyy too often people consider the second one of those “inspiration”. But it’s not, it’s simply copying with an attempt made at not being caught. Stop it.

Also, do a search before you make a product. When someone makes something they own copyright, whether you saw if before making yours or not. They made it first.

Example : I had a great idea once for banner ad rotators that rotated like a cube, shading and everything like it was 3D. Before making it I did a search on FD and found that Damojo already has EXACTLY what I was gonna make. Notice it’s not in my portfolio, I didn’t make it after seeing that.

I noticed it to, i posted it once at a file that it looked the same like others and the result was that some people get mad at me, my reaction gets removed and i was the bad man… so it shows you don’t have to be original to sell stock :) :P
