What does "Your use of the Work is limited to a single application" mean?

Can somebody please explain what “Your use of the Work is limited to a single application.” means?

I’ve been waiting for days for answer from support.

I’m a photographer, and there is software on this website that allows you to create a gallery out of your photos. I want to buy the extended license so I can sell each of my galleries as apps.

Can I do that? If I buy the extended license can I create an app out of each of my galleries? I have four galleries so that would make 4 apps.

It’s a simple question.

It means you can only use the “code” of what you buy for 1 (ONE) single gallery you intend to sell. If you wish to sell 10, you can buy 10 basic licenses… if however the price of an extended license is more to your liking, as far as I know you can purchase one of those, and it grants you far better rights. I am pretty sure that you might require an extended license in order to be allowed to “resell” the initial code + your own additions (photos in this case), so that might be the safe way to go, and why not, if you have a lot of future work planned using that item, it might even be cheaper than purchasing every single license 1000 times over.

Thank you. So if I buy the extended license which is what I plan on doing, I only have to buy it once and I could create multiple apps? Is that correct? I don’t have a problem doing that, but if I have to buy an extended license for every gallery app I want to sell then forget it, it would be way too expensive.

if I look at the details it says under extended license:

Your use of the Work is limited to a single application.

That’s what I’m not understanding.

Technically speaking, you’d have to purchase an extended license for any project you intend to RE-SELL. If you’re doing just a few galleries for different clients, then you’d have to just buy regular licenses for every single client, but seeing as you’re purchasing the galleries and reselling them together with your images, I doubt it’s the same thing. I will flag my message for staff reply, maybe you get a quicker reply than through usual support channels.

later edit : under the regular license, point D) You must not directly or indirectly license, sub-license, sell or resell the Work, or redistribute the Work alone (even for free), or offer to do any of these things. All of these things are referred to as Resale.

and point G) You must not incorporate the Work in a work which is created for Resale by you or your client.

pretty much rule out the regular license. I am now wondering about the multiple use clause… give me a sec to do some lite reading :D

later edit nr2. : here are the specific parts on the Extended license that might be interesting :

e)You may use the Work in a work which you are creating for your own purposes or for your client who has asked you to create it. You may incorporate the Work in a work which is created for Resale by you or your client (provided that (i) only the complete work is offered for sale, (ii) where technically possible, you must ensure the Work cannot be extracted as a stand-alone item from the second work, and (ii) the terms of sale prohibit the buyer extracting or re-using the Work as a stand-alone item). You may display the Work, and make the Work available for use by an unlimited number of your clients, in conjunction with a web site service that you host on behalf of your clients. When using the Work through a web site service, you may make unlimited copies of the Work but you must procure that your clients do not reproduce or use the Work in another application.

It’s so confusing. I just want to be able to sell my pictures as an app. I really hope I don’t have to buy an extended license for every app cause there is noway I’m doing that.

How long should I expect a reply from Twitter support? I sent a message about license question over a week ago. Buyer purchased extended license just to be safe. I don’t think that’s fair to buyer if not necessary.

I opened a ticket about this subject with them days ago, and I haven’t heard a peep. Contrastblack is trying to help which I’m very grateful for, and I hope I can get a response from support fairly soon.

If not, I’m starting to question if I really should buy from this site since I haven’t heard from support at all. It would be ashamed too because the template I want to purchase is exactly what I want.

I guess we’ll see.

I was told by support that you need to buy an extended license for EACH app you wish to sell.

So if I want to list 4 of my photo galleries, I would have to pay $380 for 4 extended licenses.

That’s way out of my price range for a template. I guess I have to go elsewhere.

what software was used in the gallery app? is it a priority code or is it public code?

if it is public code, then you can find this code and implement it yourself. for example, if the nivo slider is being used, that has not been created by the author of the theme/template but free versions of it are readily available which for example he may have used in his product. after all, if the code for the app is publicly available, he is using it for free, and he doesn’t pay for it, why should you?
