IMPORTANT

I have found something in fotolia FAQ section that states the following…

Do my pictures of people require a model release?
Yes all pictures of recognizable people will require you to submit a signed model release.

Do I need a model release if the photo is a self portrait?
Yes, even if the photo is a self portrait you need to provide a signed model release for us to keep on record.

This means that all images purchased via fotolia have model releases otherwise hence they would be not be approved for sale on fotolia.

This settles everything.

They will not be clear until they will be same applied across ALL marketplaces. And now i go back with Kermit…

If you have only just found that then you should have had both of your files that used faces rejected (not just the second one), until you provided that information to the reviewer. Perhaps you were lucky and the reviewer of the first file knew the Fotolia’s model release policy … but don’t forget .. the reviewer is not required to know the rules of all stock asset sites. It is still the author’s job to inform the reviewer about the terms and conditions under which they are using stock assets.

Don’t forget .. the reviewer is not required to know the rules of all stock asset sites. It is still the author’s job to inform the reviewer about the terms and conditions under which they are using stock assets.

If we just put there is a model release uploaded by the images’ author. Is that enough?
You’d have to also tell us that you’ve checked and it’s legal to distribute (assuming it’s in the download package as well). I’m not familiar with all photo sites, but I can tell you that you can use iStock photos in previews, but not the download package.
Can’t reuse same images in another template, unless you have purchased another licence.
That depends on the license, but this will usually be the case. Most stock licenses are for one time use. If you contact fotolia and it’s different, no worries. Just let us know in the notes to the reviewer.

there’s something i really don’t understand about being so much “careful” regarding external assets.

we do have to check this before upload:
Any images / sounds / video / code / flash used which are not my own work have been appropriately licensed for resale. Other than these items, this work is entirely my own and I have full rights to sell it on ActiveDen.
which is enough for code but not for assets.

i’ve included assets on my items for which i contacted original authors and asked for permission, to be sure i won’t break any law by using such material.

coz, due to that checkbox, i’m the one accountable for copyright violations.

why that’s not enough ? why do i have to see my item rejected coz i was not clever enough to convice reviewer it was my right to use those assets ?
