Ah yes, it’s been in our terms of usage for some time, but I think we need to do a community push around it.
Our aim is to help authors across the marketplaces cross sell each other’s files. Ultimately when a buyer sees stuff they like in a preview, they may (hopefully) go and buy those same items!
I don’t understand if we need to ask for permission from the author of the item on videohive, photodune or other marketplace, before we use his preview image, video, audio in our preview?
Off course respecting the four rules specified in “Assets You’re Welcome to Use” (only include the watermarked preview – only include it in the preview, not the main download – clearly link to the file in your description – state clearly that the file itself is not included in the main download)
Also, are this preview options available for all marketplaces? Including Themeforest, 3DOcean or GraphicRiver?
Thank You.

I read this old post, http://notes.envato.com/authors/using-photodune-images-in-your-marketplace-files/
Q. Can I take a watermarked PhotoDune preview image and use it in my marketplace file preview?
As long as you get permission from the author first, yes. If you DO get permission and you end up using the watermarked image in your preview file, you must credit the PhotoDune photographer/author in your marketplace item description. You may not use/redistribute the preview images in your main file(s).
And I had tried to contact many PhotoDune authors to ask their permission to use their PhotoDune watermarked images. Guess what? No reply from all of them…

Why don’t just buy a regular license? They are really cheap (especially this month)

For people asking if there’s images/videos/sounds/photos one can use rather than maybe infringe on some copyrights. Have a look at our own Envato Asset Library for some really great stuff. Make sure to read the Asset Guidelines for information on how one are allowed to use them. These assets comes from the community and have shown to be a valuable asset for anyone in need of materials for Preview Images.
Also, if one are unsure about what type of items one can use it’s a must to read this Wiki article right here – What Images, Videos, Code or Music Can I Use in my Items?
I’d say it’s very important to read that section in the wiki, especially if you work with Print Templates, Videos, Add-Ons or Theme development.
EDIT : It’s also highly encouraged to use photos from PhotoDune, either the watermarked image with a permission slip from the author or purchase a license to have the rights to use it. (do the right thing, purchase the photograph and give a linkback to the original item to support the author)
EDIT By Jordan_M: It’s actually a new (2010) part of our terms of use that authors can use watermarked photos from PhotoDune as part of their previews without prior permission from the author.

Yup, I regularly buy PhotoDune images with regular license for my projects. It is very cheap and I always recommend it. Using non-watermarked images for live preview is better and more professional…
In my post above, I just want to share my personal experience for asking permission from PhotoDune authors…

I think if You linkback to original item it should also work vice versa
For this reason I bought the GraphicRiver bundle with PhotoDune images and I intend to use the images only in theme preview.
How am I going to credit authors if I don’t have slightest idea whose photos are those? The bundle item page is deleted/deactivated.
Should I credit PhotoDune only? Is this fine?

well that I was intending to do, but if I use the watermarked photo the author may gain sales if someone like it and follow the link I put in the description, so is not that I’m stealing it or something
we both gain benefit from this.
but since someone may not like it for some reason, to give the preview files to other authors, I made that question, since the FAQ with the rules doesn’t specify the permission from the author as mandatory so I think is allowed.

you don’t need to put a link to anything since you paid for those photos for one use only (one preview)
you can be nice and add a link to photodune or the photos specific page if you want, but is not mandatory if you purchased the regular license.

If you use watermarked-images, to credit PhotoDune authors is a MUST !
If you buy a regular license, to credit PhotoDune authors is optional. It is better to do to support the authors.
